1. Acceptance of Terms

By accessing or using Open-Accord ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Platform. Your continued use after changes constitutes acceptance.

2. Eligibility

  • You must be at least 13 years old to use the Platform.
  • Users between 13-17 may require parental consent (when family features are available).
  • You must provide accurate registration information.
  • You are responsible for maintaining the security of your account.

3. User Conduct

You agree NOT to:

  • Post content that violates our Community Guidelines
  • Harass, bully, or intimidate other users
  • Share misinformation or unverified claims as fact
  • Post AI-generated content without disclosure
  • Spam, advertise, or engage in commercial solicitation without permission
  • Impersonate others or misrepresent your identity
  • Attempt to circumvent security measures or access restrictions
  • Use automated tools to access the Platform without authorization
  • Violate any applicable laws or regulations

4. Content Ownership & License

Your Content: You retain ownership of content you post. By posting, you grant Open-Accord a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform.

Platform Content: Open-Accord and its licensors own all rights to the Platform's design, features, and functionality.

Removal: You may delete your content at any time. We may retain backups for a reasonable period for legal and operational purposes.

5. Verification & Premium Services

  • Verification is available for $50/year via Stripe.
  • Verified users receive a blue checkmark and access to premium features.
  • Subscriptions auto-renew unless cancelled.
  • Refunds are available within 7 days of purchase if no premium features were used.
  • We reserve the right to revoke verification for Terms violations.

6. Moderation & Enforcement

We may, at our sole discretion:

  • Remove content that violates these Terms or Community Guidelines
  • Warn, suspend, or permanently ban accounts
  • Reduce visibility of low-quality content based on community feedback
  • Report illegal content to appropriate authorities

You may appeal moderation decisions through our appeals process. Appeals are reviewed within 7 business days.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT CONTENT WILL BE PRESERVED.

We are not responsible for user-generated content. Users are solely responsible for their posts and interactions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPEN-ACCORD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Termination

You may delete your account at any time through Settings. We may terminate or suspend your account for Terms violations.

Upon termination, your right to use the Platform ceases immediately. Sections 4, 7, 8, and 10 survive termination.

10. Governing Law & Disputes

These Terms are governed by the laws of Malaysia. Any disputes arising out of or related to these Terms or the Platform will be resolved in the courts of Malaysia, unless mandatory consumer protection laws in your jurisdiction require otherwise.

You agree to waive any right to participate in class action lawsuits against Open-Accord.
